Tahir Humayun and others V. High Court of Balochistan through Registrar and others,

YLR 2015 2349 · Balochistan High Court

This case concerns the seniority of judicial officers in Balochistan. Several judges, magistrates, civil judges and additional district and sessions judges had been appointed on an ad hoc basis in 1997-1999. Later, the Provincial Cabinet and the High Court's Administration Committee regularized their services, but backdated their seniority to their original ad hoc appointment dates. Other officers, including the appellants, who had been appointed on a regular basis through the Public Service Commission before this regularization, argued that this retrospective backdating unfairly pushed them below officers who were actually junior to them in regular service.

The Balochistan High Court agreed with the appellants. It held that ad hoc service, before being formally regularized, cannot count toward seniority - seniority should instead run from the date of substantive (regular) appointment. The Administration Committee had no authority to grant seniority retrospectively from the ad hoc appointment date, and doing so was an arbitrary and unreasonable exercise of power that harmed regularly appointed officers. The court emphasized that illegal actions do not become legal simply through the passage of time, and that void orders can be challenged without any limitation period.

The court declared the appellants and similarly placed officers senior to the respondents whose ad hoc service had been retrospectively regularized, and directed that their promotion cases be reconsidered accordingly. This ruling matters because it protects merit-based, regularly recruited employees from being unfairly overtaken in seniority by administrative shortcuts.

بلوچستان ہائی کورٹ نے اپیل کنندگان کے مؤقف سے اتفاق کیا۔ عدالت نے قرار دیا کہ باقاعدہ ریگولرائزیشن سے پہلے کی
