Government of Balochistan through Secretary Education Department V. Messrs campaigner associates (pvt.) Ltd. through Chief Executive and 2 others,

PLJ 2018 Quetta 30 · Balochistan High Court

This case involved a dispute over an unpaid construction contract in Balochistan. A private company, Campaigner Associates, had been contracted to build workshops, classrooms and a hostel for a government polytechnic institute in Quetta. After completing the work, the company claimed the Provincial Education Department failed to pay amounts owed, including for extra work done beyond the original contract.

When the parties could not agree on arbitrators to resolve the dispute, the trial court appointed an independent umpire with the consent of both sides. The umpire heard both parties and issued an award in the contractor's favor. The government failed to file any formal objections to this award within the legal timeframe required under the Arbitration Act, 1940, despite being given multiple opportunities to do so. As a result, the trial court made the umpire's award a formal decree of the court.

The government appealed, arguing the contractor was not entitled to extra payments and that the award was unjustified. The Balochistan High Court rejected this appeal, finding that the government had not properly objected at the right stage, that the earlier court order allowing objections had never been challenged and become final, and that the contractor had completed the work to the department's satisfaction without any prior complaints. The court upheld the trial court's decision, dismissing the government's appeal.

This case matters because it reinforces that government bodies must follow procedural rules and deadlines just like any other party, and cannot avoid contractual payment obligations by raising objections late or without valid grounds.
