PLD 2016 Balochistan 44 · Balochistan High Court
This case involved a land dispute in Chagi district, Balochistan, over property known as Khaskhain Nali. The respondents, belonging to the Syed Kalani tribe, claimed historical ownership of the land, arguing that the appellants and their ancestors were merely tenant farmers (bazgars) who had fraudulently gotten revenue entries changed into their own names decades earlier. After an earlier suit against a related tribe, the respondents withdrew part of their claim and filed a fresh suit against the present appellants in 2004, which the trial court (Majlis-e-Shoora) decided in their favour in 2008.
The appellants challenged this decision before the Balochistan High Court, arguing the suit was time-barred, lacked proper evidence of fraud, relied on unproven documents, and failed to include the Government of Balochistan despite involving unsettled land.
The High Court agreed with the appellants. It held that merely withdrawing an earlier suit and filing a new one does not create a fresh cause of action or reset the limitation period. Since the disputed revenue entries dated back to 1967-68, and the respondents could not explain this long delay, the suit was barred by time. The court also found no evidence proving fraud, and noted that suits concerning unsettled government land must include the government as a party.
As a result, the High Court set aside the trial court's judgment and dismissed the original suit, allowing the appeal. The case highlights the strict application of limitation laws and procedural requirements in property disputes.
