Muhammad Rasool v. State,

PCrLJ 2012 750 · Balochistan High Court

This case involved three men, Muhammad Rasool, Asmatullah and Rohullah, convicted by an Anti-Terrorism Court in Quetta for possessing and preparing explosives, after police raided a house in July 2008 and found them assembling a bomb, along with large quantities of explosive material, detonators and a vehicle rigged with explosives. They were sentenced to 14 years' rigorous imprisonment each under the Explosive Substances Act and Anti-Terrorism Act.

On appeal, the Balochistan High Court examined whether the trial court had jurisdiction, especially since one accused, Rohullah, was a minor at the time of the offence. The appellants argued the Juvenile Justice System Ordinance should have applied instead. The court held that the Anti-Terrorism Act overrides other laws, including the Juvenile Justice System Ordinance, and that jurisdiction of an Anti-Terrorism Court depends on the nature of the offence, not the age of the accused. It also rejected arguments that police witnesses were unreliable or that lack of independent witnesses weakened the case, noting people are often reluctant to get involved in such matters.

The court upheld the convictions of all three, finding the evidence of red-handed arrest and recovery of explosives credible. However, because Rohullah was a juvenile who may have acted under his elder brother's influence, his sentence was reduced from 14 to 8 years, while the other two sentences were maintained.
