Pervaiz V. The State,
PCr.LJ 2025 1246 · Balochistan High Court
This case involved an applicant named Dilawar, accused in a 2021 FIR of entering a complainant's house with others and firing on the complainant's son, causing bullet injuries, under charges of attempted murder and robbery/dacoity with intent to cause death or grievous hurt. He had earlier been granted bail by the trial court, but that bail was cancelled by the High Court on merits. He later applied again for bail, this time arguing that he had already spent a long time in jail without his trial concluding, and that the delay was not his fault.
The Balochistan High Court examined the law under section 497 of the Criminal Procedure Code, which states that if an accused is detained for more than one year in a non-death-penalty case, and the delay in trial is not due to the accused's own actions, the court must grant bail. The record showed the applicant had been in custody for one year and nine months, prosecution evidence was still incomplete, and both his lawyer and the state's counsel agreed the delay was not his fault.
Based on this statutory ground, the court granted him bail, requiring sureties worth Rs. 500,000. This case illustrates how prolonged pretrial detention without progress in trial can itself become a valid legal ground for bail, reinforcing the principle that personal liberty should not be indefinitely restricted due to court delays beyond the accused's control.
