Vice-Chancellor, University of Balochistan v. Chancellor,
MLD 2012 1597 · Balochistan High Court
This case is about a legal dispute over the tenure of a university's Vice-Chancellor. The petitioner had been appointed Vice-Chancellor of the University of Balochistan in 2010, under a notification that set his term at two years. He accepted those terms and served without objection. When his two years were about to end, he himself wrote to the Chancellor noting his contract was expiring, and was then appointed as an Acting Vice-Chancellor on a temporary basis. Only afterward did he challenge the original notification, arguing that the University of Balochistan Act, 1996 actually guarantees a four-year term, making the two-year limit illegal.
The Balochistan High Court rejected his petition. It held that since he had voluntarily agreed to the two-year term, worked under it without protest, and only raised the issue after his tenure ended, he had effectively waived his right to claim a longer term. The court explained that waiver occurs when someone knowingly gives up a legal right through their actions or silence rather than enforcing it. It also found the petition was filed too late (barred by "laches"), since he raised the issue only after two years had passed.
This case matters because it reinforces the legal principle that a person who accepts and acts under certain terms cannot later challenge those same terms after benefiting from them, especially after significant delay.
