7529/2021 Const. P. Mumtaz Shah (Petitioner) V/S Fed. of Pakistan and Others (Respondent) Sindh High Court Bench: Hon'ble Mr. Justice Adnan-ul-Karim Memon(Author), Hon'ble Mr. Justice Zulfiqar Ali Sangi Order Date: 11-FEB-26 While pensionary benefits constitute a recurring cause of action, such a principle does not dispense with the requirement of establishing entitlement under the governing rules. Since the petitioner was granted the promotion increment admissible to him and did not opt for alteration of his promotion date, denial of the additional annual increment cannot be termed illegal or discriminatory, as agitated by the petitioner after his retirement from service in the year 2021. 14. For the foregoing reasons, the petitioner has failed to make out a case of violation of law or constitutional right warranting interference by this Court in the exercise of its constitutional jurisdiction. Consequently, the petition is dismissed along with pending application(s) with no order as to costs.
