Information relied upon by the Complainant-applicant of events which took place during the public procurement proceedings, in particular, the alleged conduct of certain officers present at the complaint redressal committee, did not make out a cognizable offence, especially when the applicant-complainant had also initiated civil litigation against the procurement agency to declare the bidding a misprocurement. Ex-Justice of Peace rightly rejected the application under Section 22-A and B Cr.Pc.
