68/2025 Const. P. M/s Marvo Exports (Petitioner) V/S Farman Khan & Another (Respondent) Sindh High Court

Bench: Hon'ble Mr. Justice Adnan-ul-Karim Memon(Author), Hon'ble Mr. Justice Zulfiqar Ali Sangi Order Date: 01-APR-26

In view of the above, the impugned judgment is not sustainable in law, as it is based on conjectures, improper presumptions, and misapplication of legal principles. The same has resulted in grave miscarriage of justice and warrants interference by this Court in exercise of its constitutional jurisdiction under Article 199 of the Constitution. 13. Accordingly, it is concluded that the impugned judgment dated 17.12.2024 passed by the learned Sindh Labour Appellate Tribunal is set aside, and the well-reasoned judgment of the learned Labour Court is restored.
