For the reasons given in the aforesaid judgments, in my view, there can hardly be any doubt that Respondent-Company is also a ???person??? within the meaning of Article 199(1) (a) (ii) read with clause (5) thereof. The learned five Member Bench of the Supreme Court in the case of Pakistan Defence Officers' Housing Authority and others v. Lt. Col. Syed Jawaid Ahmed and other connected appeals supra has answered the question about the maintainability of the petition against the government-owned and controlled companies.
