5857/2021 Const. P. Nafees Ahmed Khan (Petitioner) V/S Province of Sindh and Others (Respondent)
Sindh High Court
Bench: Hon'ble Mr. Justice Adnan-ul-Karim Memon(Author), Hon'ble Mr. Justice Zulfiqar Ali Sangi
Order Date: 23-APR-26
In view of the above statutory framework, settled principles of law, and factual matrix, it is evident that the impugned order dated 17.09.2020 does not suffer from any jurisdictional defect or illegality warranting interference under Article 199 of the Constitution. Rather, it reflects a correct exercise of appellate jurisdiction aimed at ensuring compliance with the fundamental principle of fair hearing and due process of law under the Cooperative Societies Act, 1925 and the Constitution. 17. Accordingly, the petitioner has failed to establish any illegality, material irregularity, or jurisdictional error in the impugned order. The petition, therefore, appears to be misconceived, lacking merit, and is dismissed, leaving the parties to pursue their remedies before the competent forum for proper adjudication of title and possession issues, if so advised.Full judgment text for this case is not yet available on Pakistan Law Reports.
