Dr. Kashif Bin Zaheer & Dr. Amber Nehan Kashif (Petitioner) V/S Federation of Pakistan & others (Respondent) Sindh High Court Bench: Hon'ble Mr. Justice Adnan-ul-Karim Memon(Author), Hon'ble Mr. Justice Zulfiqar Ali Sangi Order Date: 08-APR-26 Consequently, the impugned letters dated 24.02.2020, 04.08.2020, 27.10.2023, and 18.06.2025, to the extent of recovery and penalty, cannot be sustained in law. 15. Accordingly, the petition is disposed of along with pending application(s) whereby the impugned recovery proceedings are declared illegal and without lawful authority. The Respondents shall forthwith cease further deductions from the salaries of the Petitioners; Any amount already deducted shall be refunded or adjusted reasonably within a stipulated period; The cases of the Petitioners for grant of PhD allowance and annual increments shall be considered strictly in accordance with law; However, it is clarified that if any liability is to be determined, the same shall be done strictly after providing the Petitioners a fair opportunity of hearing through a transparent and reasoned process.
