Discretion of Banking Court while examining the Application for Leave to Defend under Section 10 of FIO, 2001 and at the time of the announcement of Judgment, to set-off and adjust the liability of the Respondent-Bank to adjust / setoff the Order passed by the Division Bench under Writ Jurisdiction directing the Respondent-Bank to pay the Appellant-Customer his salary and dues. Appellate Court has power under FIO, 2001 to adjust/set-off liabilities payable between parties, inter se. Appeal partly allowed.
