The appeal was allowed with no order as to costs, and the impugned judgment and decree were set aside with direction to the learned Banking Court to decide the Suit expeditiously. Needless to say the Suit shall proceed ex-parte against appellants 2 and 3 as they did not file any application for leave to defend.
