If the provisions of Section 12(2) CPC are allowed to facilitate a stranger to the suit whose rights have not been affected by the outcome, the provisions are not available for the applicant as otherwise it would open the floodgate of litigation for initiating the proceedings. The application under section 12(2) CPC filed by Saeed Allahwala appears to be misconceived.
