In principle the remand is not to be ordered as a matter of course; rather, it is to be ordered only where the order is passed without jurisdiction, without hearing, or in violation of principles of natural justice. 11. In the present case, the petitioner was afforded full opportunity of hearing before both the forums below; therefore, the request for remand is misconceived. Resultantly, since the petitioner has failed to point out any jurisdictional defect, illegality, misreading or non-reading of evidence, or perversity in the impugned orders, and the request for remand is merely to fill the lacuna in the case, no case for remand is made out. Consequently, the constitutional petition is liable to be dismissed. 12. Accordingly, this petition is dismissed along with listed application(s).
