279/2018 Const. P. Jawaid Akhtar (Petitioner) V/S S.L.A.T & Ors (Respondent) Sindh High Court

Bench: Hon'ble Mr. Justice Muhammad Faisal Kamal Alam, Hon'ble Mr. Justice Jawad Akbar Sarwana(Author) Order Date: 07-JUL-25

While the Sindh Labour Court had no jurisdiction to adjudicate the petitioners grievance, at the same time, as per the law in force at the material time, the petitioner could have sought his remedy in writ jurisdiction. Now that it has undisputedly come on record that the petitioner was removed from service contrary to fair trial and due process on the part of the Competent Authority/HESCO, the petitioner is fully entitled to relief in constitutional jurisdiction. Petition allowed.
