A plaint which contains allegations of fraud, cannot be rejected under Order VII Rule 11 CPC. and evidence is to be recorded in such cases. Inquiry and calling of witnesses is not permissible at the stage of hearing of an application under order VII rule 11 CPC. Declaring a document as forged by the trial Court, at the stage of Order VII rule 11 CPC., is not permissible.
