Respondent did not deny the date contended by petitioner when it received the copy of determination by NEPRA by TCS courier. The petition was filed within the statutory time for filing an appeal, but the NEPRA Appellate Tribunal, although established, was not functional at material time as per the observation of the Supreme Court of Pakistan. Petition maintainable. Matter remanded to the Authority for denovo proceedings.
