The perusal of record reveals that when the case was at the verge of its final disposal learned trial Court amended the charge against the appellants, thereby inserted section 302 PPC was inserted. On amendment so made as per requirement of section 231 Cr.P.C the witnesses, which were already examined were to have been reexamined on the amendment so made in the charge. It was not done by learned trial Court. Not only this, but no fresh statements of the appellants u/s 342 Cr.P.C were recorded and thereafter the impugned judgment was rendered.
