248/2024 Const. P. Mst. Shereen Wd/o Late Mehmood Khan (Petitioner) V/S Sajjad Hussain (Respondent) Sindh High Court

Bench: Hon'ble Mr. Justice Abdul Hamid Bhurgri(Author) Order Date: 09-APR-26

The doctrine of judicial notice is confined to matters of common knowledge or facts capable of indisputable verification. It cannot be invoked as a substitute for adjudication of disputed questions of fact requiring appreciation of evidence. The reliance placed by the learned appellate Court upon "judicial notice" for determining the question of default, therefore, constitutes misapplication of law. Matter remanded to the appellate court for fresh decision. Petition disposed of.
