It cannot be invoked as a substitute for adjudication of disputed questions of fact requiring appreciation of evidence. The reliance placed by the learned appellate Court upon "judicial notice" for determining the question of default, therefore, constitutes misapplication of law. Matter remanded to the appellate court for fresh decision. Petition disposed of.
