The plaintiffs paid the full price of the Suit Land under the Sale Agreement and then paid off the Defendant Seller's 75% of the outstanding loan amount to Zarai Tarkiati Bank Ltd. The Bank acknowledged the funds deposited by the Plaintiffs and Defendant. Defendant Seller still denied the Agreement of Sale on the ground that he never signed the said Agreement and Plaintiffs were his tenant. Defendant produced no evidence in support of his defence. Suit for Specific Performance granted. Suit decreed.
