No notice before filing of a Suit is mandatory under section 70 of The West Pakistan Agricultural Development Corporation Ordinance, 1961 as it is only applicable in respect of an act purporting to be done under this Ordinance, whereas, impugned orders were passed under the West Pakistan Land Revenue Act, Bar of jurisdiction of a Civil Court is not always absolute; but in exceptional circumstances when an action is without jurisdiction or is tainted with mala fides, the court has jurisdiction.
