Prima facie, there is no mala fide of the complainant to lodge the FIR of the incident against the applicant. Previous conviction of the applicant in a criminal case as discussed supra, disentitle him for extraordinary relief as provided under Section 498 Cr.P.C. Also, there is nothing placed on record by the applicant, which could show that the applicant has been acquitted from the aforesaid case by the learned appellate Court.
