The customs officials have only held the goods and have not passed an order as required under section 17 of Customs Act, 1969 that whether on account of such deviation and in the light of Methyl Bromide test/fumigation having been performed and certificate of physical inspection having been issued by the Department of Plant Protection whether the subject consignment could be subjected to the detention, seizure, confiscation or could be subjected to the fine/ penalty only or otherwise.
