In light of what has been held above, the Impugned Order is hereby set-aside, consequently the matter is remanded back of the learned Tribunal for deciding the same on merits after recording of evidence. The learned Tribunal is further directed not to be influenced with the findings in the Impugned Order. Accordingly, instant Misc. Appeal is allowed in the above terms with no order as to cost.
