Const. P. 203/2026 (D.B.) Hyder Shaikh V/S P.O Sindh & Others Sindh High Court

Bench: Hon'ble Mr. Justice Arbab Ali Hakro(Author), Hon'ble Mr. Justice Muhammad Osman Ali Hadi

An employee of a Local Council, though a public servant under Section 151 of the Act of 2013, is not a civil servant; but Rule 26 of the Rules of 2017 carried the benefit of Rule 11-A to him mutatis mutandis until 18.10.2024. After Muhammad Jalal, no fresh entitlement survives; a right accrued on a death before that date stands preserved alike for both classes, with limitation running from majority where the dependant was a minor.
