R.A (Civil Revision) 173/2023 (S.B.) Late Alllah Dino Through his LRs V/S Muhammad Zafar & Others Sindh High Court

Bench: Hon'ble Mr. Justice Arbab Ali Hakro(Author)

A registered thirty-year-old deed is presumed genuine under Articles 85(5), 100 and 129(e) QSO, 1984. The burden shifts to its beneficiary only once the challenger goes beyond bare denial. Its cancellation is governed by Article 91 of the Limitation Act, and forgery gives no immunity from time. A reversing decree that ignores those presumptions, awards possession and mesne profits without findings, and binds co-heirs never impleaded cannot stand. Non-joinder calls for impleadment, not dismissal.
