R.A (Civil Revision) 192/2018 (S.B.) Muhammad Tagial Maitlo V/S Wazeer Ali & Others Sindh High Court

Bench: Hon'ble Mr. Justice Arbab Ali Hakro(Author)

An oral sale agreement, unproved for want of particulars and independent evidence, gives no right to cancel a registered deed, section 39 aside, because it creates no interest in land. A co-defendant's admission through an attorney who never deposed cannot displace the deed's presumption. The purchaser for value in good faith is protected by section 27(b) unless notice is brought home to him.
