Const. P. 1540/2025 (D.B.) Hosh Muhammad Panhwar V/S P.O Sindh & Others Sindh High Court

Bench: Hon'ble Mr. Justice Arbab Ali Hakro(Author), Hon'ble Mr. Justice Muhammad Osman Ali Hadi

The saving in GPO v. Muhammad Jalal protects only appointments actually made, and the rule that an appointee suffers not for the appointing authority's lapse presupposes an appointment, forgery being the absence of one, not a lapse. Where the department denies any appointment, Article 212(3) is no bar, as genuineness of signatures is a disputed fact outside Article 199. A fresh inquiry on notice and hearing is directed under Article 10-A, that being a lesser relief within the relief sought and not a suo motu action.
