A disciplinary authority cannot silently escalate its own Enquiry Officer's findings, from 'irregularity' to 'dishonesty' without recorded reasons, where the enquiry exonerates an employee on the principal charge and recommends only a warning, dismissal is not merely a departure from that finding but a disproportionate and discriminatory penalty unsustainable in law.
