A Magistrate acting on a report under section 173 Cr.P.C is not a criminal court, so no revision lies, even if section 561-A applies to an abuse of process. He must apply his own mind to cognisance, and if the offences are exclusively triable by a Special Judge, record reasons, decline cognizance, and return the report. He may neither choose the investigating agency nor direct how it shall proceed, and custody of an accused passes only by order of a competent court.
