Ms. Asmat Ara & Another V/S Ms. Inayat Begum (Deceased) & Others Sindh High Court Bench: Hon'ble Mr. Justice Muhammad Faisal Kamal Alam, Hon'ble Justice Ms. Sana Akram Minhas(Author) Section 53-A of Transfer of Possession Act, 1882 - Judicial construction, scope and applicability of Section 53-A - Part-performance cannot be invoked where possession arose solely from a tenancy, unless tenant has done some act in furtherance of the agreement of sale. Limitation Act, 1908 - Subjective considerations, friendship or family ties cannot override or extend statutory limitation periods - By its very nature, it is strict and inflexible - It does not confer substantive rights but merely regulates the enforcement of rights.
