The primary consideration however remains that Order I Rule 10(2) CPC which is being heard, does not allow the applicant to be either necessary or proper party. Necessary party is one who ought to have been joined as party in whose absence no effective decree could be passed whereas proper party is one whose presence before the Court is necessary to enable the Court to effectually and completely adjudicate upon and settle all questions involved in the suit.
