Simple dishonorment of the cheque is not an offence u/s 489-F PPC unless it is shown to have been issued dishonestly in repayment of loan or in fulfillment of some obligation. When there was no evidence of either transaction of sale of house as alleged by the complainant nor evidence of amount of Rs.60,00,000/- paid to the applicant by her; there was no question of returning the amount to the complainant by applicant through a cheque.
