With regard to the claim of damages of Rupees Two Hundred Crores, for suffering mental agony and physical torture, no evidence has been led by the Plaintiff in support of the same. If Plaintiff was physically assaulted, the first thing, which comes to mind, is that whether any complaint was lodged with the Police? Plaintiff has not led any evidence, nor brought on record anything about the fact that he was physically tortured or suffered mental agony. Thus, this claim also cannot be accepted in absence of positive evidence, as onus to prove the same is on Plaintiff, but he failed to discharge it.
