17/2014 Cr.J.A Qurban Ali @ Qaboo (Appellant) V/S THe state (Respondent) Sindh High Court Bench: Hon'ble Mr. Justice Muhammad Iqbal Mahar, Hon'ble Mr. Justice Irshad Ali Shah(Author) Order Date: 05-NOV-19 Appellants filed appeal against the judgment where trial Court convicted and sentenced They may be hanged by neck till they are dead, Accused Nabi Bux was also with them therefore, he is sentenced to suffer R.I for life. death sentence to appellants Qurban @ Qaboo and Mubarak @ Makboo is concerned, it requires to be modified simply for the reason that there was no deep rooted enmity between the parties and dispute between them was over landed property. appellants Qurban Ali @ Qaboo and Mubarak @ Makboo for an offence punishable u/s 302(b) PPC for having committed Qatl-e-Amd of Shadi Khan and Gul Muhammad (on two count) is modified into Rigorous Imprisonment for life with fine of Rs.50,000/- payable by each of them to legal heirs of each of the deceased as compensation .Appeal and death reference are disposed of accordingly.
