In view of the above, the impugned order is liable to be annulled as being arbitrary, discriminatory, and violative of Articles 4 and 25 of the Constitution, and the petitioner/ interveners/similar employees are entitled to the same incentive time-scale benefit as granted to District Attorneys more particularly in terms of ratio of the judgments passed by this Court as discussed in the preceding paragraphs. 16. At the same time, it cannot be overlooked that the Petitioner and other similarly placed officers have remained stagnated for a considerable period due to the non-availability of a proper service structure, which prima facie calls for the attention of the competent authority. The recommendations of the Law Department and Prosecutor General Sindh also reflect acknowledgment of this structural deficiency. 17. In these circumstances, it is appropriate to direct the competent authority of the Respondents to expeditiously consider and finalize the matter of service structure and promotional avenues for the Criminal Prosecution Service, in light of this Court???s judgment dated 01.06.2021 passed in C.P. No. 1736/2013, and observation recorded hereinabove; and thereafter give meaningful consideration to the case of the Petitioner for all consequential benefits, including pensionary purposes on merits. 18.
