Studies confirm that in parental conflicts, which are not resolved privately and within a shorter period, the children suffer psychological distress, with increased risk of developing fear, anxiety, sadness, depression, insecurity, instability, emotional dysregulation, mood swings and impulsivity. ??? For expeditious disposal of family disputes, and to curtail unnecessary litigation in family disputes, writ jurisdiction under Article 199 may not be exercised routinely, since the legislature. ??? Need for harmonisation and transformation of child-related laws with the United Nation???s Convention on the Rights of the Child 1989 [CRC], ??? while dealing with child-related laws, a fundamental shift in approach is needed, from ???welfare of the child??? to ???rights of the child???. ??? Section 12 of the Guardian & Wards Act needs to be regulated and formalised. ???
