Furthermore, it is a well settled principle of law that where the law required an act to be done in a particular manner, it had to be done in that manner alone and such dictate of law cannot be termed as a technicality or mere formality, and where things have not been done in the manner, as required by the law and procedure, the same cannot be given legal sanctity particularly when the same are resulting in penal consequences or causing irreparable injury to an individual
