Dilawar V. The State,

YLR 2025 671 · Balochistan High Court

Dilawar vs. The State (reported as part of a combined judgment with Pervaiz vs. The State) arose from a 2019 shooting in Gwadar district, Balochistan, in which one man was killed and another injured. The trial court had convicted the appellant Pervaiz of murder and attempted murder, sentencing him to life imprisonment and additional punishment for causing injury, while acquitting two co-accused. Three connected matters came before the Balochistan High Court: the convicted man's appeal against his conviction, the victim's widow's petition seeking a harsher sentence, and her separate appeal against the acquittal of the other two accused.

The High Court examined the evidence carefully, including eyewitness testimony from the deceased's brother and the surviving injured friend, who both consistently identified the appellant as the shooter. This was backed by medical evidence confirming firearm injuries, and forensic evidence showing that recovered bullet casings matched a pistol seized from the appellant, along with blood-stained material confirmed by laboratory testing.

The court held that being related to the victim does not automatically make a witness unreliable, especially when the testimony is consistent and withstands cross-examination. Finding the prosecution's case proven beyond reasonable doubt, the court dismissed the appeal against conviction. This case illustrates how courts weigh eyewitness accounts alongside forensic evidence to determine guilt in serious violent crimes.
