Syed Muhammad V. The State,

YLR 2025 339 · Balochistan High Court

This case involves a bail application before the Balochistan High Court by Syed Muhammad, who was accused of murder under Pakistan's Penal Code. He was charged along with two other men for allegedly shooting and killing a man named Azizullah in December 2022. The trial court had earlier refused him bail.

The key issue was that all three accused were said to have played the same role in the shooting. However, one co-accused had already been acquitted by the trial court after being given the benefit of the doubt, and another co-accused had been granted bail. Since the applicant was accused of the identical role as these two men, the High Court applied what is called the rule of consistency or doctrine of parity, meaning that when accused persons face the same allegations, they should generally be treated the same way unless there is a clear difference in their roles.

The prosecution argued that the applicant should be denied bail because he had been absconding after the incident, but the court held that mere absconding is not proof of guilt and does not automatically block bail if the case otherwise qualifies on its merits.

The court concluded that keeping the applicant in custody would serve no purpose, since the matter would ultimately be decided through trial evidence. Bail was therefore granted.

This case is important because it reinforces how fairness and consistency between co-accused must be considered at the bail stage, and clarifies that absconding alone is not sufficient reason to refuse bail.
