Kashmir alias Soba Khan V. The State,

YLR 2025 1401 · Balochistan High Court

This case involved an appeal by a man convicted of murdering his brother along with the brother's wife, a crime also involving rioting charges. The Balochistan High Court reviewed the evidence against him and found serious problems with the prosecution's case.

First, the FIR (police report) was lodged 22 hours late, even though the distance to the police station could have been covered in 8-9 hours, and police had actually arrived at the crime scene before the FIR was even filed-suggesting time was taken for deliberation about who to accuse rather than reporting spontaneously.

Second, the complainant mentioned a police official who informed him of the murder, but that official was never produced as a witness, creating doubt.

Third, the court found the alleged eyewitness's account implausible-questioning why the attackers would spare him if he could identify them, and noting his statement was oddly recorded only after the FIR, not before.

Fourth, the crime occurred at 3:00 am, yet no evidence was presented showing any light source existed to allow identification of the attackers.

Finally, both the complainant and the eyewitness had significantly changed their statements between two different court appearances, first implicating one set of accused and later excluding an already-acquitted co-accused while still naming the appellant-damaging their credibility.

Given these cumulative doubts, the court allowed the appeal and overturned the conviction, highlighting how delay, unreliable witnesses, and inconsistent testimony can undermine a murder case.
