Muhammad Usman and another V. The State,
YLR 2023 555 · Balochistan High Court
This case involved two appellants, Muhammad Usman and Bilal Ahmed, convicted by a trial court in Chaman for the murder of Muhammad Saddique, sentenced to life imprisonment under section 302(b) of the Pakistan Penal Code. The prosecution's case relied mainly on circumstantial evidence and the appellants' confessional statements recorded before a judicial magistrate, since there were no eyewitnesses. The defense argued the recovered pistol and crime empties were never sent to a forensic laboratory for matching, weakening the circumstantial evidence, and challenged the reliability of the confessions, partly because they were recorded fifteen days after arrest.
The Balochistan High Court found that while the weapon recovery lacked forensic corroboration, the recovery of the dead body was strong supporting evidence, and the confessions were recorded voluntarily with proper safeguards by the magistrate. However, examining the confession as a whole, the court found that only one appellant had planned and committed the murder, motivated by alleged past assault by the deceased, while the other had merely helped conceal evidence afterward without participating in the killing itself.
As a result, the court partly allowed the appeal: the main appellant's conviction was reduced from section 302(b) to 302(c), with his sentence cut from life imprisonment to fifteen years, while the second appellant's murder conviction was set aside and replaced with a conviction under section 201 (destroying evidence), carrying a five-year sentence. The case highlights how courts carefully separ
