YLR 2023 2683 · Balochistan High Court
This case involved a family dispute over an ancestral house in Quetta among siblings who were declared co-owners by a trial court, which ordered the brother in possession to either buy out his siblings' shares or let the house be sold and proceeds divided. During execution of this decree, the court sent the property to public auction, and an outside bidder won with the highest offer. However, the brother who had possession of the house had also expressed willingness to buy it, and he objected to the auction process, arguing it violated legal procedure and that he was not properly notified or heard.
The Balochistan High Court agreed with him. It found multiple serious flaws in the auction: no proper notice was given to the co-owners, no reserve price was fixed as required by law, the sale proclamation wasn't displayed on the court notice board, and crucially, the winning bidder failed to deposit the remaining 75% of the purchase price within the legally mandated 15 days. Since the sale was never formally confirmed and the payment rules weren't followed, the court ruled the entire auction was invalid under the Civil Procedure Code's rules governing execution sales.
The High Court set aside the lower courts' orders and ruled in favor of the brother in possession, allowing him to purchase the house himself provided he deposits the full sale amount plus a required 5% penalty. This case underscores that courts must strictly follow procedural safeguards in auction sales to protect co-owners' rights and ensure fairness.
