YLR 2023 1595 · Balochistan High Court

This case involved an appeal against convictions for murder, attempted murder, and rioting arising from a 1995 incident in which several people, including the complainant's brother, nephews, and a labourer, were killed or injured due to alleged prior enmity. The Balochistan High Court examined the evidence closely and found serious flaws in the prosecution's case.

The complainant, who was not an eyewitness, never appeared in court to testify despite summons, and his original police report showed he was uncertain about the identity of the attackers when the FIR was filed. A key injured witness changed his account dramatically over the years, naming the accused only after a nineteen-year gap, contradicting his earlier statement describing masked attackers. Two other witnesses claiming to be eyewitnesses were found to be interested and biased relatives of the victims, and their account was implausible because they claimed to be present during heavy gunfire yet were untouched despite being obvious targets given their relationship to the deceased.

Based on these inconsistencies, dishonest improvements in testimony, and the implausible nature of the witnesses' accounts, the court concluded the prosecution failed to prove the case beyond reasonable doubt. The appeal was allowed, and the conviction was overturned.

This case matters because it demonstrates how courts scrutinize witness credibility, delays in testimony, and implausible narratives to protect the fundamental principle that the prosecution must prove guilt beyond a reasonable doubt before someone can be convicted of a serious crime.
