This case involved Aadil, who was convicted by a trial court in Turbat under the Control of Narcotic Substances Act, 1997, for possessing 15 kilograms of charas (a narcotic drug) found during a police raid on his house. The trial court sentenced him to 15 years imprisonment plus a fine, citing mitigating factors such as the police not involving independent witnesses or obtaining a search warrant.
On appeal, the Balochistan High Court examined the relevant law closely. Under Section 9(c) of the Act, possession of narcotics exceeding one kilogram can attract punishment ranging from 14 years imprisonment up to death or life imprisonment. However, a proviso to this section specifically states that if the quantity exceeds 10 kilograms, the punishment cannot be less than imprisonment for life.
Since Aadil was caught with 15 kilograms, well above the 10-kilogram threshold, the law mandated a minimum sentence of life imprisonment. The trial court had overlooked this mandatory legal requirement and imposed a lesser sentence of 15 years instead.
The High Court held that this was an error of law that the trial court had missed. As a result, it set aside the trial court's judgment and sent the case back for the sentence to be decided afresh in line with the correct legal requirement. This case highlights how courts must strictly follow mandatory minimum sentencing provisions in narcotics cases, especially for large quantities of drugs, regardless of other circumstances considered during sentencing.
