Abdul Hadi V. Jafar khan and 3 others,

YLR 2022 Note 57 · Balochistan High Court

This case involved an appeal filed by Abdul Hadi, the complainant in a criminal case, against the acquittal of three accused persons. The accused had been charged under sections of the Pakistan Penal Code dealing with causing injuries (shajjah and jaifah) with common intention, after allegedly attacking Abdul Hadi's uncle, Rehmatullah, with a stick and stones on a roadside in Loralai district in 2018. The trial court had acquitted the accused before full evidence was recorded, accepting an application filed under section 249-A of the Criminal Procedure Code.

The Balochistan High Court dismissed the appeal on two independent grounds. First, it found the appeal was filed late. Under the law, an appeal against acquittal must be filed within thirty days, but this appeal was filed fifty-eight days after the trial court's order, and no proper explanation was given for the delay, despite an application seeking condonation of it. Second, and importantly, the court held that Abdul Hadi himself was not legally entitled to file the appeal because he was not the injured person, only a witness and relative. The law requires that only the actual injured victim, if not a minor or of unsound mind, can challenge such an acquittal. Since the uncle who was actually injured did not file the appeal himself, the complainant's appeal was incompetent.

This case highlights strict procedural limits on who can appeal acquittals and the importance of timely legal action.
