Para Din V. The State,

YLR 2022 Note 53 · Balochistan High Court

This case involved Para Din, who was accused of abducting four young children belonging to his brother's wife, Bibi Sira. The complainant alleged that her husband was a drug addict, that she lived separately with her children at her father's house, and that the petitioner, along with relatives, forcibly took her four children, aged between one and seven years. The children were later recovered by police from a room in a dairy farm in Quetta, not a residential home.

The trial court convicted Para Din under Section 363 of the Pakistan Penal Code (kidnapping) and sentenced him to three years' imprisonment plus a fine. His appeal was dismissed, and he then filed this criminal revision petition before the Balochistan High Court.

The petitioner argued that the children's own father had taken them, claiming lawful guardianship. However, evidence showed the father was actually in jail at the time of the abduction and had multiple prior narcotics convictions, discrediting this defense. The court held that being the children's uncle did not entitle Para Din to their custody, and that only a father could claim the legal exception under Section 361 PPC, and only if acting in good faith for lawful purposes.

Finding the complainant's and witnesses' testimony consistent and credible, and no legal errors in the lower courts' judgments, the High Court dismissed the revision petition and upheld the conviction. The case reinforces that only legitimate guardians can claim exceptions to kidnapping charges, and relatives have no automatic right to take children from their lawful custodian.
