Mujeeb-Ur-Rehman V. The State,

YLR 2022 Note 126 · Balochistan High Court

This case involved a man convicted separately in two different trials for stealing two different cars, based on two separate police complaints filed months apart. In each case, he was convicted under Section 381-A of the Pakistan Penal Code and sentenced to three years' rigorous imprisonment plus a fine. His appeals against both convictions were dismissed by the Sessions Judge, after which he filed revision petitions before the Balochistan High Court.

Before the High Court, his lawyer did not contest the convictions themselves but asked that the two sentences be allowed to run concurrently (at the same time) rather than one after the other, relying on provisions of the Criminal Procedure Code. The State did not object.

The court explained that one provision (Section 35) only allows concurrent sentences when a person is convicted of multiple offences in a single trial—which was not the situation here, since these were separate trials for separate thefts committed at different times and places. However, another provision (Section 397) gives courts discretion to order sentences from different trials to run concurrently. Using this discretion, the judge dismissed the appeals on merit but directed that the sentences in both cases run concurrently, meaning the man would not have to serve the two three-year terms back-to-back. This clarifies how courts handle multiple convictions from separate trials.
